A tract of 119 acres of land on the south side of Bardstown Road was purchased from E. K. Rehm for $100,000. The syndicate who originated the cemetery open an office in Rooms 422 and 423 of the Marion E. Taylor Building. The Resthaven Memorial Park and Cemetery Association incorporated on 3 December 1926 by M.E. Reiff, Herbert Huck, and H.C. Lovelace. The Resthaven Memorial Cemetery incorporated on 22 November 1927 by Lewis C. Tingley, S. Edward Vogt, Louis E. Keller with a $350,000 investment.
In an ad which ran on 22 August 1926 in the Louisville Courier-Journal, the business opening the cemetery indicated, "A rural retreat sacred to the dead: Resthaven Memorial Park will follow the park-lawn plan. Everything is planned to present and always preserve restful and pleasing quiet, its beautiful works of art and its every-varying charms of nature, sacred to the memory of the dead forever."
