This cemetery is located in a meadow at the south corner of the more southerly of the two intersections of FM 969 and Weber St. in Webberville, Texas. The exact extent of the cemetery is uncertain. Only three marked burials are known, all of which are in the part of the partially fenced meadow near the the historic Ebenezer Baptist Church. The church is located southwest on Weber Street adjacent to the partially fenced meadow. A modern Dollar General is located adjacent to the meadow on FM 969. There are three marked burials, the most prominent being for Matthew Duty, who has a historic marker noting that he was "killed and scalped by Indians in the Spring of 1837." Two of the them, Duty and Nash are fenced in by ornamental fencing. A third marker, for Glover, is located a short distance to the west in the open.

The cemetery is most commonly known as Duty Cemetery due to its most prominent burial. It is also known as Duty-Webberville Cemetery or just Webberville Cemetery because of its location in the center of Webberville within shouting distance of Webberville Village Hall. Similarly it is also known as Ebenezer Baptist Church Cemetery or Webberville Ebenezer BaptistChurch Cemetery because it is adjacent to said church. Oddly, it is also known as Woods Cemetery, because for unknown reasons it is called that on USGS maps. This has led to confusion between it and Banks Wood Cemetery on the northern edge of Webberville, which is also called Woods Cemetery on USGS maps.
