Marion enlisted as a Private in Company G, 43rd Georgia Infantry on March 4, 1862 at Jefferson, Jackson County, Georgia. He was wounded in both legs at the Battle of Baker's Creek, Mississippi on May 16, 1863 and captured at Champion Hill, Mississippi on the same day [apparently because of the severity of his wounds he was turned back over to Confederate forces]. His name appears on an undated register of beneficiaries of the Association for the Relief of Maimed Soldiers, Richmond, Virginia. Due to the wound to his left leg turning gangrenous, it was amputated on July 28, 1863 in Demopolis, Alabama. He was discharged on February 17, 1864 by order of General Joseph Johnston. Marion applied for an artificial limb on November 1, 1864.

From his Certificate of Disability: He was born in Jackson County in the State of Georgia, is thirty-two years of age, five feet eleven inched high, fair complexion, blue eyes, light hair, and by occupation, when enlisted, a farmer.

The Atlanta Constitution, March 12, 1912 - Commerce, GA March 11-Special
